El derecho a la salud es parte fundamental de los derechos humanos y de lo que entendemos por una vida digna. El derecho a disfrutar del nivel m\u00e1s alto posible de salud f\u00edsica y mental, por decirlo con todas las palabras, no es nuevo.<\/p>\n

En el plano internacional, se proclam\u00f3 por primera vez en la Constituci\u00f3n de la Organizaci\u00f3n Mundial de la Salud (OMS), de 1946, en cuyo pre\u00e1mbulo se define la salud como “un estado de completo bienestar f\u00edsico, mental y social, y no solamente la ausencia de afecciones y enfermedades”. Tambi\u00e9n se afirma que “el goce del grado m\u00e1ximo de salud que se pueda lograr es uno de los derechos fundamentales de todo ser humano, sin distinci\u00f3n de raza, religi\u00f3n, ideolog\u00eda pol\u00edtica o condici\u00f3n econ\u00f3mica o social”.<\/p>\n

En la Declaraci\u00f3n Universal de Derechos Humanos, de 1948, tambi\u00e9n se menciona la salud como parte del derecho a un nivel de vida adecuado (art. 25). El derecho a la salud tambi\u00e9n fue reconocido como derecho humano en el Pacto Internacional de Derechos Econ\u00f3micos, Sociales y Culturales, de 1966. Desde entonces, se ha reconocido o se ha hecho referencia al derecho a la salud o a elementos del mismo, por ejemplo el derecho a la atenci\u00f3n m\u00e9dica, en otros tratados internacionales de derechos humanos.<\/p>\n

El derecho a la salud es importante para todos los Estados:\u00a0todo Estado ha ratificado por lo menos un tratado en el que se reconoce ese derecho. Adem\u00e1s, los Estados se han comprometido a protegerlo en el marco de declaraciones internacionales, leyes y pol\u00edticas nacionales y conferencias internacionales.<\/p>\n

El presente folleto informativo tiene por objeto arrojar luz sobre el lugar que ocupa actualmente el derecho a la salud en las normas internacionales de derechos humanos.<\/p>\n
