Na\u00e7\u00f5es Unidas (ONU), de acordo com sua Carta de 1945.<\/p>\n<p>Tr\u00eas anos depois, em 10 de dezembro de 1948, a Declara\u00e7\u00e3o Universal dos Direitos Humanos foi adotada pela Assembl\u00e9ia Geral das Na\u00e7\u00f5es Unidas. A partir de ent\u00e3o, nove tratados de direitos humanos foram criados &#8211; a maioria deles com protocolos opcionais-, os quais, juntamente com a Declara\u00e7\u00e3o Universal, formam o n\u00facleo do sistema universal de prote\u00e7\u00e3o dos direitos humanos.<\/p>\n<p>Al\u00e9m disso, existem mais de 60 instrumentos de direitos humanos de natureza n\u00e3o-obrigat\u00f3ria &#8211; diferentes dos tratados-, mas que fornecem princ\u00edpios e diretrizes em diferentes \u00e1reas de aplica\u00e7\u00e3o dos direitos humanos, por exemplo, nas for\u00e7as de seguran\u00e7a, na administra\u00e7\u00e3o de justi\u00e7a, no sistema penitenci\u00e1rio e no desenvolvimento sustent\u00e1vel.<\/p>\n<p>De acordo com sua origem, o Sistema das Na\u00e7\u00f5es Unidas possui dois tipos de mecanismos de direitos humanos:<\/p>\n<ul>\n<li>Os mecanismos ou <strong>\u00f3rg\u00e3os baseadas na Carta das Na\u00e7\u00f5es Unidas<\/strong>, incluindo o Conselho Econ\u00f3mico e Social (ECOSOC) e o Conselho de Direitos Humanos, que d\u00e3o origem \u00e0 Revis\u00e3o Peri\u00f3dica Universal (RPU) e aos Procedimentos Especiais (Relatores Especiais, Especialistas Independentes e Grupos de Trabalho).<\/li>\n<li>Os mecanismos ou \u00f3rg\u00e3os criados segundo os nove tratados internacionais de direitos humanos e seus protocolos (conhecidos como <strong>\u00f3rg\u00e3os de tratados<\/strong>). Estes s\u00e3o Comit\u00eas regulados no pr\u00f3prio tratado, formados por especialistas independentes selecionados e eleitos pelos Estados Partes segundo crit\u00e9rios de \u00e9 um \u00f3rg\u00e3o intergovernamental composto por 47 Estados-Membros, respons\u00e1vel pela promo\u00e7\u00e3o e prote\u00e7\u00e3o de todos os direitos humanos em todo o mundo. O Conselho foi criado para lidar com situa\u00e7\u00f5es de viola\u00e7\u00f5es de direitos humanos e fazer recomenda\u00e7\u00f5es a esse respeito. Ele tem a capacidade de discutir todas as quest\u00f5es tem\u00e1ticas relacionadas a direitos humanos e situa\u00e7\u00f5es que requerem sua aten\u00e7\u00e3o ao longo do ano.<\/p>\n<p>O Conselho foi criado pela Assembl\u00e9ia Geral em 15 de mar\u00e7o de 2006. Ele se re\u00fane tr\u00eas vezes por ano em Genebra, na Su\u00ed\u00e7a, e \u00e9 um \u00f3rg\u00e3o subsidi\u00e1rio da Assembl\u00e9ia Geral da ONU. Consistem na nomea\u00e7\u00e3o de uma pessoa ou grupo de pessoas, e recebem v\u00e1rias denomina\u00e7\u00f5es: <strong>Relator\/a Especial, Especialista Independente ou Grupo de Trabalho.<\/strong><\/p>\n<p>Os titulares de Procedimentos Especiais s\u00e3o nomeados pelo Conselho de Direitos Humanos, servem em sua capacidade pessoal, n\u00e3o fazem parte do pessoal das Na\u00e7\u00f5es Unidas e n\u00e3o recebem sal\u00e1rio por suas atividades. Essas pessoas se comprometem a realizar seu trabalho com independ\u00eancia, efici\u00eancia, compet\u00eancia, probidade, imparcialidade, honestidade e boa-f\u00e9. Os \u00f3rg\u00e3os de tratados de direitos humanos s\u00e3o comit\u00eas de especialistas independentes encarregados de supervisionar a implementa\u00e7\u00e3o de tais tratados.<\/p>\n<p>Ao ratificar um tratado, os Estados Partes t\u00eam a obriga\u00e7\u00e3o de adotar medidas para que todas as pessoas sob sua jurisdi\u00e7\u00e3o possam gozar dos direitos estipulados naquele instrumento.
